This specialist ensures that groundbreaking innovations supported by Quantum TTO are properly protected (through patents, copyrights, trade secrets as applicable) and that effective licensing strategies are in place to enable commercialization. Working in concert with university TTOs’ IP offices, researchers, and industry licensees, the IP and Licensing Specialist navigates the complex patent landscapes of quantum computing, quantum communication, and related fields. They structure deals to license or assign technologies to industrial partners or spin-out companies, balancing the interests of all parties. Given Quantum TTO’s global reach, this role also addresses international IP considerations and compliance, making certain that intellectual property rights are secured and transactions are conducted with a high degree of legal rigor and ethical standards.

About Quantum TTO

Quantum TTO (Technology Transfer Office) is an Applied Quantum specialized team focused on commercializing quantum research for global markets. This role would be operating within the Quantum TTO team. We expedite the journey from laboratory discoveries to fully realized products and solutions, forging strategic alliances with universities, startups, and industry leaders. Our mission is to accelerate adoption of quantum technologies—whether in computing, cryptography, sensing, or secure communications—and ensure that groundbreaking innovations make the leap into widespread use. By offering expert guidance in intellectual property, licensing, funding opportunities, and market strategy, Quantum TTO serves as the catalyst that helps visionary ideas reach their maximum commercial potential.

Key Responsibilities

  • Patent Portfolio Management: Oversee the identification, filing, and prosecution of patents for quantum technology innovations emerging from partner universities and projects. Work with inventors (scientists/engineers) to draft high-quality invention disclosures and coordinate with patent attorneys or agents to file patents in relevant jurisdictions. Manage a portfolio of quantum-related patents and patent applications, tracking critical deadlines and maintenance fees.
  • IP Strategy Development: Develop comprehensive IP protection strategies for each project or spin-out, aligned with its business objectives. This includes deciding on the form of IP protection (patent vs. trade secret), jurisdictions to file in (considering major markets), and timing of filings relative to publication or product development milestones. Conduct freedom-to-operate analyses or enlist outside counsel to ensure new ventures will not infringe third-party rights.
  • Licensing and Commercialization Deals: Lead the structuring and negotiation of licensing agreements for quantum technologies. Identify potential licensee companies or startups for a given technology, market the opportunity (in collaboration with the Director of Partnerships and Market Analyst), and negotiate terms such as field-of-use, exclusivity, royalties, milestone payments, and sublicense rights. Ensure that agreements equitably address the interests of the originating research institution, Quantum TTO, and the licensee.
  • Collaboration Agreements: Advise on and help draft intellectual property terms in collaboration contracts, consortium agreements, and sponsored research agreements involving quantum IP. Make sure that issues of ownership, licensing rights, and future use of jointly developed IP are clearly defined among partners, protecting the long-term commercial potential of innovations.
  • IP Due Diligence: Perform due diligence on quantum technologies under consideration for commercialization support. This involves evaluating the novelty of the invention, existing patent landscape searches to gauge patentability, and assessing any encumbrances on the IP (such as government rights or prior licenses). Provide clear recommendations on IP risks and strengths to inform go/no-go decisions on projects.
  • Advisory to Spin-Outs: Guide spin-out venture teams on IP issues critical to their business. Assist academic founders in understanding how to license the needed IP from their university, and ensure they establish appropriate IP ownership for any new developments. Help structure equity-for-IP or royalty arrangements when a spin-out is formed around university-owned patents.
  • Monitoring Compliance: Ensure all IP-related activities adhere to relevant laws, regulations, and institutional policies. This includes compliance with Bayh-Dole Act provisions for federally funded inventions (if in the U.S.), export control regulations for quantum encryption technologies, and reporting obligations to stakeholders. Maintain clear records of IP agreements and implement tracking to ensure licensees fulfill their obligations (e.g., royalty reports, milestone achievements).
  • Education and Training: Provide training or informational sessions to researchers and partner TTO staff about best practices in intellectual property management for quantum technologies. Increase awareness on the importance of early disclosure, avoiding public disclosures before patent filings, and strategies for building strong patent claims in the quantum field.
  • IP Portfolio Valorization: Continually evaluate the portfolio of quantum IP for opportunities to create value. Recommend when to abandon non-viable patents, and identify high-value patents that could be pooled or jointly licensed for broader adoption. Work with the Market Intelligence Analyst to map how protected innovations align with market needs or investor interests, thereby enhancing the attractiveness of the IP to external parties.

Required Qualifications and Experience

  • Educational Background: Bachelor’s or Master’s degree in Physics, Engineering, or related field plus credentials in intellectual property (such as a J.D. with focus on patent law, or certification as a Patent Agent). Candidates with a dual technical and legal background are preferred.
  • Professional Experience: 5+ years of experience in intellectual property management, technology transfer, or patent law. Experience specifically with patents in high-tech or scientific fields is required; exposure to quantum technology patents or similarly complex domains (semiconductors, advanced materials, cryptography) is highly valuable.
  • Licensing Expertise: Demonstrated experience negotiating and drafting technology licensing agreements. Familiarity with various licensing models (exclusive, non-exclusive, cross-licensing, etc.) and the financial structuring of deals (royalties, equity stakes, etc.). A history of successfully closed licensing deals or partnerships is a strong plus.
  • Patent Law Knowledge: Deep knowledge of patent prosecution processes in major jurisdictions (e.g., USPTO, EPO, etc.) and international IP treaties (PCT, Patent Cooperation Treaty). Ability to evaluate patent claims and guide legal counsel on technical aspects. Ideally registered to practice before a patent office (e.g., USPTO registration for US candidates).
  • Quantum Technology Acumen: Good understanding of the science and technology behind quantum innovations – able to comprehend concepts like qubit architectures, quantum algorithms, photonic systems, quantum cryptographic protocols, etc. This enables effective communication with inventors and better strategic IP decisions.
  • Attention to Detail: Exceptional detail-orientation, as managing IP requires precision in documenting legal terms, tracking dates, and ensuring compliance. Strong analytical skills to assess complex legal/technical information and identify key points.
  • Communication & Interpersonal Skills: Excellent written and verbal communication skills for interacting with a broad range of stakeholders: researchers (to gather invention info), attorneys, corporate executives in licensing discussions, and internal team members. Able to explain IP concepts clearly to non-specialists.
  • Problem-Solving: A pragmatic approach to resolving IP issues that arise, such as inventorship disputes, overlapping claims with another institution’s patents, or a licensee’s request for expanded rights. Ability to find creative solutions that maintain protection while enabling progress in commercialization.
  • Integrity and Confidentiality: Strong ethical standards in handling sensitive and confidential information. Trustworthy in managing proprietary data and negotiations, with a clear commitment to protecting the interests of partner institutions and innovators in line with legal frameworks.

Preferred Skills or Attributes

  • Tech Transfer Certification: Professional certifications or designations such as RTTP (Registered Technology Transfer Professional) or CLP (Certified Licensing Professional) are a plus, indicating formal recognition of expertise in technology commercialization and licensing.
  • International IP Experience: Experience dealing with intellectual property issues across multiple countries. Familiarity with differences in patent laws (e.g., software or algorithm patentability in different jurisdictions), and experience securing foreign patents or handling international license deals.
  • Industry Knowledge: Awareness of the competitive IP landscape in quantum tech – e.g., which corporations or entities are filing significant patents in quantum computing or quantum communications. This knowledge can guide strategy (to find white spaces or to avoid infringing areas).
  • Legal Agreement Diversity: Experience with a variety of agreements beyond standard licensing, such as joint development agreements, material transfer agreements (MTAs) for quantum prototypes, or consortia IP frameworks.
  • Negotiation Skills: Highly refined negotiation skills, including the ability to achieve outcomes that foster long-term partnerships. Able to stand firm on critical issues (like protecting core IP rights) while finding common ground on flexibility (like field-of-use to encourage adoption).
  • Collaboration & Advisory: A collaborative mindset to work closely with other departments. Willingness to advise the Director of Strategic Partnerships and other team members on IP implications of their initiatives, ensuring intellectual property is appropriately addressed in all strategic decisions.

Reporting Line

Reports to the CEO in the interim and later to the designated Head of Commercialization Programs. Given the specialized nature of this position, the IP and Licensing Specialist operates with considerable autonomy but coordinates frequently with the Director of Strategic Partnerships for aligning IP activities with partnership goals, and with legal counsel when necessary.

Location and Travel Expectations

Remote. Travel: Moderate travel (around 10–20%) is expected. This may include visits to partner universities to meet inventors and TTO staff, attendance at key industry IP/tech transfer conferences, and occasional travel to meet companies during licensing negotiations. Most work can be accomplished from the main office, but maintaining relationships and understanding context may require on-site presence as needed.
